Tiivistelmä
Suomen oikeusjärjestelmässä on tapahtunut lukuisia muutoksia viime vuosina. Tässä tutkimuksessa muutoksia tutkittiin rikostuomareiden näkökulmasta. Opinnäytetyön tavoitteena oli selvittää, mitkä muutokset käräjäoikeuksien rikostuomarit ovat kokeneet vaikuttavimmiksi, sekä rikostuomareiden käsityksiä nykyisen lautamiesjärjestelmän merkityksestä osana käräjäoikeuden päätöksentekoa. Opinnäytetyön ohjausorganisaationa toimi oikeusministeriön oikeushallinto-osaston tuomioistuinyksikkö.
Teoriaosuudessa selostetaan Suomen oikeusjärjestelmää ja tarkemmin käräjäoikeuksien toimintaa sekä kerrotaan lautamiesten roolista käräjäoikeudessa. Työn tutkimusosa koostuu kyselytutkimuksen vastausten raportoinnista ja analysoinnista. Kysely sisälsi sekä tilastollisia että avoimia kysymyksiä. Tutkimus suoritettiin kokonaistutkimuksena käräjäoikeuksien rikostuomareille sähköisenä Webropol-kyselynä kaikissa Suomen käräjäoikeuksissa Ahvenanmaata lukuun ottamatta.
Kysely osoitti, että tuomarit ovat kokeneet kokoonpanouudistuksen onnistuneen hyvin ja yleisesti ollaan sitä mieltä, että uudistus tehosti käräjäoikeuden oikeudenkäyntien sujuvuutta. Suurimpina viimeaikaisina työhönsä liittyvinä muutoksina tuomarit ovat pitäneet vuonna 2006 voimaan tullutta mahdollisuutta rikosasioiden kirjalliseen menettelyyn, vuoden 2009 kokoonpanouudistusta ja vuoden 2010 käräjäoikeuksien rakenneuudistusta. The Finnish judicial system has undergone numerous changes during the last few years. This thesis studies these changes from the viewpoint of criminal judges. The aim of this study was to find out which changes the criminal judges of District courts have considered to be the most effective, and to examine the judges’ views on the role the present lay member system has as a part of the decision making process in district courts. The supervising organisation for this thesis was the Court Administration Unit of the Department of Judicial Administration in the Ministry of justice.
The theoretical background for this study consists of a general introduction of the Finnish judicial system, as well as a detailed description of district court proceedings and the role lay members have in district courts. The research data was collected by conducting a survey on all Finnish criminal judges, excluding judges in the Åland Islands. The survey method was a Webropol online questionnaire which included both closed and open-ended questions. The results are reported and analysed in Section 6.
The results of the survey showed that the judges have found the composition reform to be successful and the general view was that the reform has made the district court proceedings more efficient. There are three major changes that the judges consider to have had the biggest impact on their work: the written procedure in criminal cases that took effect in 2006, the composition reform of 2009, and the district courts’ structural reform of 2010.
